1. INTRODUCTION AND DEFINITIONS
In these Rules “the Company” means Alto Hospitality limited (trading as Evolve Gym) which provides the Club and its facilities for the benefit of the Members; “the Club” means “Evolve Gym”; “Member” means a Club Member; “Directors” mean the Directors of the Company; “Rules” mean the terms and conditions of membership set out below; “Application Form” means the Application Form completed by the Member to join the Club; “the General Manager” means the General Manager appointed by the Company to control the day to day running of the Club. It is a condition of membership that Members agree to pay the fees referred to in Rule (2.) and agree to be bound by these Rules. These Rules may be revoked, altered or added to from time to time by the Company, without prior notification to Members. Any such variations will be posted on our website and club notice boards. The Company has created these Rules for the mutual enjoyment of the Members and their guests. The enforcement of these Rules is for the good of all Members.
2. MEMBERSHIP AND FEE
Members must be at least 16 years of age.
Members shall pay a non-refundable joining fee at the time of joining at the rate specified. Membership payments shall be payable monthly in advance.
Membership Fees once paid are non-refundable.
Members must give notice to the Club of any change of email address. Failing such notice, all communications shall be presumed to have been received within 5 days of the postmarked date.
All membership fees are reviewed annually, usually on the 1st January, and members will be notified of any changes by email by giving one full calendar months’ notice.
The Company reserves the right to refuse an application from any applicant for any reason. Membership is non-transferable and non-refundable.
If any monthly fees or charges incurred are not paid when they fall due, the company reserves the right to temporarily refuse the member access to the club until such time as full payment has been made. If any monthly fees or charges incurred are not paid within 15 days after falling due, membership shall be terminated and the club may pursue any rights it may have to recover the unpaid amount. Upon termination of membership, no refund of the admin fee, monthly fees or other fees shall be issued. To re-join the Club after a termination of membership, any unpaid subscriptions must be cleared, a new membership agreement completed and the prevailing admin fee charged.
Membership subscriptions may be increased by the Club at any time. The Club shall give the Member no less than thirty days’ notice prior to any such increase.
Members who are in arrears will be liable to pay the balance of the Subscription at the new rates.
3. MEMBERSHIP CARDS
Membership cards will be issued to all Members and must be used to activate the entrance doors to enter the Club. A valid membership card must be presented at the Front Desk upon entering the Club.
The card is Non-transferable and must not be lent or used by another person other than the Members themselves.
If any person other than Members uses a membership card, that Member’s membership may be terminated and no refunds of the joining fee or subscription will be given, plus a fee levied.
The Club reserves the right to refuse entry to any Member who does not have their card on them, even if they have paid their membership Fees.
The Club reserves the right to charge a fee for the replacement of lost membership cards.
The Company reserves the right to retain any membership card if there has been a defaulted payment by the Member concerned.
4. GUESTS
Members may bring guest to the Club on payment of the prevailing guest fee available on request.
All guest must be accompanied by an existing Member.
All guests are required to register at the Main Reception desk.
Members may bring a maximum of three guest per visit.
All guest must be a minimum of 16 years of age.
Members are responsible for ensuring that their guest are aware of, and adhere to, the Club Rules.
The Company reserves the right to refuse admission to any guest without explanation.
5. USE OF FACILITIES AND SERVICES
The Company has the right to remove any person in the Club that does not have a valid Membership, including those whose Membership subscription is in arrears.
Club opening hours are fixed by the Company and are subject to change without prior notice. The Company may at any time close the Club’s premises or any part thereof, without notice, in order to execute repairs, alterations, accommodate external events, re-decorations or otherwise, or to facilitate Club programs and on certain holidays.
Only members of staff may provide personal training services within the Club.
Any unused Personal Training sessions cannot be refunded once a member leaves.
Members are requested to arrive for studio classes in good time.
An instructor may refuse entry, or may ask any Member to leave a class if they feel theirs, or another’s, safety or enjoyment is in jeopardy.
The Company reserves the right to refuse entry to the Club’s premises at its absolute discretion. It is the Member’s or guest’s responsibility to ensure that they are capable of undergoing any activity within the Club. All activities are pursued at the Member’s own risk.
Whilst every effort has been made to ensure the accuracy of the class program, the management reserves the right to cancel or re-schedule classes after publication and at short notice. The program may be amended during public holidays.
Members may not use the Dance studios unsupervised outside the class timetable.
Use of fitness areas and other Club facilities is at the Member’s or guest’s own risk and under their own medical advice.
Proper attire, as determined by the Company, must be worn in the Club. Members are requested to wear at all times appropriate clean footwear in the fitness areas and non-marking soled footwear on the exercise studios and court floors. Footwear must be worn at all times. Members are requested to shower before entering the sauna. Shaving or exfoliating within the sauna is not allowed.
Pets are not allowed in the Club.
Smoking is not permitted anywhere in the Club.
No food should be consumed within the club.
No alcoholic beverages or drugs of any kind may be brought into the Club. Violation of this rule will result in immediate expulsion from the Club and may result in termination of membership. Members or guest shall not use the Club’s facilities whilst under the influence of alcohol or drugs. In the event that they do so, this is entirely at their own risk.
Mobile phones are allowed in the clubs but should be placed on silent whilst in the gym and changing rooms.
Members cannot take photos or videos of other members in the club and must be considerate of other members when using the mobile phone.
In the interest of safety, no glass container may be taken into any fitness areas or changing areas.
Loud or abusive language will not be tolerated.
Club property, including towels, toiletries, mats, etc., are provided by the Club as a courtesy to its Members during Club usage only. Removal of Club property from the premises may result in the termination of membership and legal action.
Member appointments for personal training that have been booked require 24 hours’ notice when cancelling. If a Member fails to attend an appointment without providing such notice, the Club reserves the right to charge the full cost of the appointment.
Members are required to leave workout areas clean and tidy.
As a courtesy to other Members and for health and safety reasons, equipment needs to be replaced in the storage areas/racks provided and equipment must be wiped down after use.
Only Personal Trainers from the Club may be used in the Club.
The Club retains the right to vary, add or eliminate any of the particular services and facilities provided, including the class timetable and class instructors.
All lost property will be recorded in the lost property log book at the Front of House and kept in a secure place. Personal items including clothes, shoes, gym equipment and toiletries will be stored for a minimum of 1 month, and valuable item including phones, jewelry, glasses and watches will be stored for a minimum of 3 months. After this personal items will donated to charity.
6. SESSIONS
Studio Classes and Spinning Classes are available to Members only
Private Training Sessions in the Club are available to Members only but must be purchased separately in addition to the Membership Subscription.
The cost of Private Training Session are available on request on the Club’s website.
Private Training Sessions expire in the year that they have been purchased and may not be carried forward into a New Year under any circumstances.
7. HOURS OF OPENING
Normal hours of operation and the hours in which the Club facilities are available to Members can be obtained upon request or from the Club’s website.
The Club reserves the right to vary these opening times.
In addition, the Company has the right at any time to close any or all of the facilities for the purpose of cleaning, building, decorations, repairs or special functions.
During public holidays, special hours apply and these can be obtained upon request or from the Club’s website.
Members are required to leave the fitness floors 30 minutes before closing times if they wish to take a shower. Members are required to vacate sauna 60 minutes before closing time.
8. LOCKERS
Lockers are available for use by Members and guests whilst they are on the Club’s premises, subject to availability.
Members must ensure that the contents of the daily lockers are removed at the end of their visit.
The club reserves the right to open lockers without the member’s permission or the member being present.
All bags must be kept in lockers and should not be taken into the fitness areas.
The Company reserves the right to remove the contents from any locker, which has not been emptied after the visit.
Property cleared from lockers, or left on the premises, shall be donated to charity after 1 month.
9. LIABILITY
Neither the Club nor the Company will accept liability for any loss, damage or theft to a Member’s or guest’s personal property brought into the Club’s premises. All activities are taken at the Member’s own risk. Neither the Club, the Company nor their servants and agents shall be liable for personal injury or death sustained by Members or their guests whilst on the Club’s premises. Members or guests who suffer an accident or injury on the Club premises must report the accident or injury and the circumstances in which it occurred to the Duty Manager immediately following the accident or injury.
10. MEMBER’S HEALTH AND SAFETY WARRANTY
Members and guests warrant and represent that they are in good physical condition and capable of engaging in exercise.
If through injury or other reason, such as pregnancy, this is not the case, they must consult a doctor before engaging in exercise and that he/she knows of no medical or other reason why he/she is not able to engage in active or passive exercise and that such exercise would not be detrimental to his/her health, safety, comfort or physical condition.
The Member shall not use any Club facilities whilst suffering from any infectious or contagious illness, disease or other ailment or whilst suffering from a physical ailment such as open cuts, abrasions, open sores or minor infections where there is a risk that such use may be detrimental to the health, safety, comfort or physical condition of other Members. The Club reserves the right to refuse access to the premises to any member that might through any of the above affect the health, safety, comfort and physical condition if other members.
In the event that a Member is unable to use the Club facilities due to injury of other reason, they shall still be liable to pay their Membership Subscription unless their membership is frozen in accordance with clause 14.
In the event that a Member refused use of or is unable to use the Club facilities due to infectious or contagious illness, disease or other ailment, open cuts, abrasions, open sores or minor infections that may be detrimental to the health, safety, comfort or physical condition of other Members, they shall still be liable to pay their Membership Subscription unless their membership is frozen in accordance with clause 14.
We recommend that before using the club you familiarize yourself with the fire exits and emergency routes in case of evacuation. Please note that employees are NOT required to “seek & search” the building. Therefore it is the responsibility of each individual to follow the relevant instructions. Please note lifts will not be operational.
11. DATA PROTECTION
It is necessary for the purpose of providing Members with advice and support in relation to our facilities to hold certain data concerning the Member’s identity, contact details and general health on our files. By signing the application form you are expressly consenting to the Club having authority to keep this data for the duration of your membership to the Club and for up to two years afterwards (or, if membership is refused for any reason, for a period of two years from the date you complete this form) to assist us in providing you with the best possible service. By signing the application form you will be indicating your consent to receiving emails and SMS messages.
12. CANCELLATION OF MEMBERSHIP
Monthly membership cancellations must be processed by the 1st of each & every month.
A full calendar month’s payment is required which means a minimum of one month and a maximum of 2 months final payment will be necessary depending on the date the cancellation form is received. For example, if a cancellation form is received on the 1st May only May will be due, however if received on 2nd May both May and June will be due.
Requests for cancellation must be made in writing. Membership cannot be amended whilst in the notice period.
Verbal instructions to amend or cancel a membership cannot be accepted without a clear request in writing and signed form.
Memberships can only be cancelled if subscription collection is active.
Monthly fees and/or prepaid fees are not refundable.
Reinstatement of a cancelled membership may be accomplished by payment of a new admin fee plus any unpaid balance from the previous membership.
13. FREEZE OF MEMBERSHIP
Members may apply to have their membership frozen.
Request for freezing must be made in writing, verbal instructions cannot be accepted, with a minimum of 7 days’ notice.
A freeze cannot be awarded retrospectively.
The minimum time for freezing is one month.
The maximum amount of time a Membership can be frozen is 3 months on an annual subscription, 2 months on a 6-month subscription and one month on a 3-month subscription.
The Member may not use the Club or its facilities during the freeze period.
Is a return date is not stated on the written request for a freeze then the Club will automatically freeze membership for the minimum period of one month after which the member will be liable to pay their monthly Membership Fee.
Once the membership has been frozen for the maximum amount of time then the Club will resume the membership subscription and unfreeze the Membership.
Request for freezing shall be at the sole discretion of the Club.
Members cannot apply to cancel while their membership is frozen.
14. TERMINATION OF MEMBERSHIP
The Company shall have the right to suspend or withdraw Membership from any Member who, in their opinion, has abused privileges or conducted himself or herself in a manner deemed detrimental to the Club staff or its Members.
Such expulsion or suspension shall become effective immediately and no reimbursement will be issued to such Member of the pro-rated portion of their unused monthly fees.
There will be no refund of the joining fee.
The Manager or a designee shall have complete charge of the Club whilst on duty.
Members may be suspended or expelled from the Club immediately if they display conduct which is, or is likely to be in the sole opinion of the Company, injurious to the character of the Club or the interests of the Members and staff, or if they commit a serious or repeated breach of these Rules, in particular where amounts owing to the Company are unpaid.
An expelled Member forfeits all the privileges of the membership and all rights against the Company.
An expelled Member will not be entitled to any refund of their joining fee or subscription and must pay all amounts owed to the Company forthwith.
15. CCTV AND SENSORS
Closed circuit cameras operate throughout the Club except in the changing areas.
The equipment is fitted with specialist sensors that can detect faults and damage.
Any unlawful activity within the Club may be reviewed for possible legal action.
A Member and a Guest will be liable for any damage to the equipment whether willful or accidental and shall be liable for its repair or replacement in full.
A Member and a Guest will be liable for any damage in the Club whether willful or accidental.
The Club and Company may immediately terminate the membership of any Member that causes damage to the equipment or the Club and engages in illegal activity and refund of Membership Fees and Joining Fee shall be given.
16. STANDARD COMPLAINTS PROCEDURE
Members and guests are encouraged to make any comment or complaint via the feedback forms located at reception and on our website.
Please ensure that all contact details are detailed on the form in order that a member of the management team can contact you accordingly to discuss. Should a member or guest wish to discuss any issue in person they can also request to speak to the manager on duty who can be contacted through the main reception. Members and guests may also contact the General Manager.
17. GENERAL
The Company may communicate with the Members via electronic mail (“email”) and/or by SMS. By providing an email address or mobile telephone number to the Company, the Member consents to receiving email and/or SMS communications from the Company, including notices pursuant to these terms and conditions. The Member also accepts that email and/or SMS may not be a secure and confidential means of communication. The Company will not be liable for any loss or damage suffered as a result of communicating with a Member by email and/or SMS. The Company may communicate with the Members via a newsletter, notice boards and through content on the Club’s website. By being a Member, the Member consents to receiving written, email and SMS communications from the Company. The Member also accepts that the newsletter and website may not be a secure and confidential means of communication and will contain photographs of Club events and functions.
The Company will not be liable for any loss or damage suffered as a result of communication in the newsletter or on the website.
Members are not to engage the services of any employee or independent contractor for use outside the Club.
